Terms of Service

1. Acceptance of Terms

By accessing or using BarqScanner (barqscanner.com), its API, the BarqScanner Station mobile app, the Keyboard Wedge desktop application, or any related services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you are using BarqScanner on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. In that case, "you" refers to both you and the organization.

If you do not agree to these Terms, do not use BarqScanner.

2. Service Description

BarqScanner is a cloud-based barcode capture and decoding platform. The service includes:

• A REST API for submitting images and receiving decoded barcode data
• A web dashboard for managing stations, API keys, and usage
• A mobile Station app (Android, Progressive Web App) for mounted-phone scanning
• A Keyboard Wedge desktop application for Windows and macOS
• A JavaScript SDK and embeddable Web Widget
• Webhook delivery of scan results to your systems

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We will make reasonable efforts to provide 7 days notice for significant changes.

3. Accounts & API Keys

You must provide accurate and complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your API keys and passwords
• All activity that occurs under your account or using your API keys
• Notifying us immediately at security@barqscanner.com if you suspect unauthorized access
• Ensuring API keys are not committed to public repositories or shared with unauthorized parties

You may create multiple API keys for different applications or team members. You can revoke any key at any time from your dashboard. We are not liable for any damage caused by your failure to keep API keys secure.

4. Acceptable Use

You agree not to use BarqScanner to:

• Scan or process barcodes in violation of any applicable law or regulation
• Abuse rate limits or attempt to circumvent usage quotas through automated means
• Reverse engineer, decompile, or attempt to extract source code from the service
• Resell or sublicense access to the API without a written reseller agreement with BarqScanner Technologies
• Use the service to process images that contain illegal content
• Attempt to probe, scan, or test the vulnerability of the system
• Interfere with or disrupt the integrity or performance of the service

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. Subscription & Billing

BarqScanner offers a free tier and paid subscription plans. By subscribing to a paid plan, you authorize BarqScanner Technologies to charge your payment method on a recurring monthly basis.

• Billing cycle: Monthly, on the same day each month as your upgrade date
• Scan limits: Unused scans do not roll over to the next month
• Overages: When you reach your scan limit, API calls return a 429 error. Scans do not continue silently
• Upgrades: Take effect immediately. You are charged a prorated amount for the remainder of the current billing period
• Downgrades: Take effect at the next billing cycle. You retain current plan features until then
• Taxes: Prices do not include applicable taxes (GST in India, VAT in UAE). Taxes are added at checkout where required

6. Data Processing

You retain ownership of all data you submit to BarqScanner. By using the service, you grant BarqScanner Technologies a limited license to process your submitted images for the purpose of providing the barcode decoding service.

We collect and store: account information (email, organization name), scan counts and metadata (number of barcodes decoded, timestamp, station ID), and API usage logs for billing and debugging purposes.

7. Intellectual Property

The BarqScanner platform, including all software, documentation, and underlying technology, is owned by BarqScanner Technologies and is protected by intellectual property laws.

You own all data you submit and all data returned to you by the API (decoded barcode results). We do not claim any rights over your barcode data or the products you scan.

The BarqScanner name, logo, and branding are trademarks of BarqScanner Technologies. You may not use them without prior written permission.

8. Limitation of Liability

BarqScanner is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that decoded barcode data will be 100% accurate in all conditions.

To the maximum extent permitted by law, BarqScanner Technologies is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of revenue, data, or business opportunities.

Our total liability to you for any claim shall not exceed the amount you paid to BarqScanner in the 3 months preceding the claim.

9. Termination

You may close your account at any time from Dashboard → Settings → Account → Delete Account. Upon account deletion:

• All API keys are immediately revoked
• Station pairings are removed
• Your account data (email, org info, scan logs) is scheduled for deletion after 30 days
• No refund is issued for the current billing period

We may suspend or terminate your account for violations of these Terms, with or without notice. In cases of serious violations (fraud, abuse), we may act immediately.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. These Terms constitute the entire agreement between you and BarqScanner Technologies regarding BarqScanner.

We may update these Terms from time to time. We will notify you by email and by posting the updated Terms on this page. Continued use of the service after changes constitutes acceptance.
